Welcome to QViagem!

These Terms of Service ("Terms") govern your access to and use of the QViagem platform, including our website, AI trip planning services, and any other features we offer (collectively, the "Service").

By creating an account or using the Service, you fully agree to these Terms. If you do not agree with any part of these Terms, you must not use QViagem.

1. Definitions and Scope

1.1. QViagem is a software-as-a-service (SaaS) tool that helps users plan travel itineraries using artificial intelligence to suggest destinations, activities, transportation, and accommodations.

1.2. These Terms apply to all users, whether visitors or paid subscribers.

2. Registration and Security

2.1. To access certain features, such as AI itinerary generation and saving trips, you must create an account with a valid email address.

2.2. You are solely responsible for keeping your credentials confidential and for all activity under your account.

2.3. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

3. Plans, Payments, and Cancellation

3.1. QViagem offers free and paid subscription plans. Features and AI credit limits vary by plan.

3.2. Billing: Payments are processed by third-party partners (such as Asaas). By subscribing, you authorize recurring charges to your selected payment method.

3.3. Right of Withdrawal: Under Article 49 of the Brazilian Consumer Protection Code (CDC), you may cancel a paid subscription within 7 (seven) days of purchase for a full refund, provided there has been no abusive use of AI credits during that period.

3.4. Automatic Renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel in account settings before renewal.

3.5. Cancellation: You can cancel at any time. Cancellation stops the next charge, but you retain access to paid features until the end of the current billing period. We do not offer prorated refunds after the 7-day period.

4. Use of Artificial Intelligence (Credits)

4.1. The Service uses AI models (such as Google Gemini) to generate suggestions. Using these features consumes "AI Credits" allocated monthly to your plan.

4.2. Credits do not roll over and expire at the end of each billing cycle.

4.3. Information Accuracy: You acknowledge that AI suggestions may contain inaccuracies, outdated information, or errors about places, prices, schedules, or availability. QViagem does not guarantee accuracy and recommends verifying critical information (such as visas, reservations, and schedules) directly with the relevant providers.

5. User Responsibilities

5.1. You agree to use the Service lawfully, ethically, and in compliance with Brazilian law.

5.2. It is prohibited to:

  • Use the Service to generate illegal, offensive, or discriminatory content.
  • Attempt to bypass usage limits or security systems.
  • Reverse engineer the platform.
  • Use automated scripts (bots) to extract data without authorization.

6. Intellectual Property

6.1. All platform content (logos, design, source code, interface text) is the exclusive property of QViagem or its licensors and is protected by copyright and intellectual property laws.

6.2. The itinerary generated for you is for your personal use. You may use and share your itineraries, but you do not acquire ownership of the AI models or underlying technology.

7. Limitation of Liability

7.1. QViagem is a planning assistance tool. We are not a travel agency. We do not make direct bookings for flights, hotels, or insurance, and we are not responsible for third‑party service failures suggested by the AI.

7.2. The Service is provided "as is." We do not guarantee uninterrupted or error‑free availability.

7.3. In no event will QViagem’s total liability exceed the total amount paid by the user in the last 6 months.

8. Privacy and Data Protection (LGPD)

8.1. The processing of your personal data is governed by our Privacy Policy, in full compliance with the Brazilian General Data Protection Law (LGPD - Law No. 13,709/2018).

9. Changes to the Terms

9.1. We may update these Terms at any time. Significant changes will be notified via email or in‑product notices. Continued use after changes constitutes acceptance of the updated Terms.

10. Governing Law and Venue

10.1. These Terms are governed by the laws of the Federative Republic of Brazil.

10.2. For disputes arising from this agreement, the parties elect the courts of Brasília-DF, waiving any other venue, except where consumer protection law provides otherwise.
